Official Rules
1. Sponsor. The Sydney HACKATHON (the "Hackathon") is sponsored by Elastic Sydney, Level 36/60 Margaret St, Sydney NSW 2000 ("Elastic" or "Sponsor").
2. No purchase necessary; binding agreement.
2.1. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. THIS HACKATHON IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW, RULE, OR REGULATION. Hackathon is subject to all applicable federal, state, territorial, provincial and local laws.
2.2. In order to enter the Hackathon, you must agree to these Official Rules (the "Official Rules"). Please read them carefully as they form a binding legal agreement between you and Sponsor with respect to the Hackathon.
3. How to participate and submission requirements
3.1. How to Participate. To be eligible to participate in the Hackathon, you must complete all the following steps during the Submission Period (as defined below): (a) complete the registration through the landing page, including describing your idea in accordance with the requirements herein; (b) one individual (the group leader) must enter the names, emails, and phone numbers of all participants in their group using the registration form, and (c) all details must be accurately entered; incorrect or faulty entries will result in disqualification. Each group must include 4–5 participants, with a maximum of five (5) participants per group. Registration and submission of an idea (collectively, your "Idea Submission") serves as an expression of interest and does not guarantee participation.
3.2. Idea Submission Requirements.
3.2.1. To submit your Idea Submission, you must ensure that your idea (a) aligns with the Hackathon theme, and (b) outlines the problem and the solution, including how Elastic technology will be leveraged in your solution. Your Idea Submission will form the basis of your Submission if you are selected to participate in the Hackathon.
3.2.2. To be considered for selection to participate in the Hackathon, your group's Idea Submission will be evaluated and scored based on all of the following criteria in equal measure: (a) alignment with the Hackathon theme, (b) clarity and relevance of the problem scenario, and (c) feasibility and creativity of the proposed solution.
3.3. To participate, you must be available to attend the Hackathon in person at the location specified below during the Hackathon Period (as defined below).
3.4. A panel of judges appointed by Sponsor will evaluate all Idea Submissions based on the criteria set out herein and will select the highest scoring Idea Submissions to participate in the Hackathon. The number of participants selected to participate in the Hackathon may be limited, as determined by Sponsor in its sole discretion. Sponsor reserves the sole and absolute discretion to evaluate all Idea Submissions and make final and binding decisions regarding participation or eligibility to participate.
3.5. You may participate only once and only as part of one group. Any attempt to participate multiple times may result in you being disqualified. In the event of an ongoing dispute as to the identity of any participant, Sponsor has the right to make determination as to the participant in its sole discretion. Sponsor reserves the right to reject any Submission and/or participant for any reason.
3.6. Submission Requirements. Your Submission, as defined in Section 4.2 herein, must conform to the following requirements (collectively, the "Requirements").
3.6.1. Functionality. Your Submission must be built using [the Idea Submission Guide. After submitting your idea, our team will review it. Once your idea is selected, your final registration will be approved.
3.6.2. Use of Elastic technology. All Submissions, projects, prototypes, and ideas must be developed using Elasticsearch as the core technology. Inclusion of competing technologies is prohibited and may result in lost points or disqualification. A competing or external product, service, or tool (an "external solution") cannot be included in your Submission, except to the extent that Elastic does not offer a solution for the specific use case for which an external (or competing) tool was used. The usage of such external solutions must not be positioned as substitutes or replacements for Elastic products or services.
3.6.3. Use of data. All data used in your Submission must be open source, synthetic, or internal and contain no customer or personal data.
3.6.4. Third-party integrations. If a Submission integrates any third-party SDK, APIs, data, and/or any information belonging to a third party, you must be authorized to use these third-party tools and information in your Submission in accordance with any terms and conditions or licensing requirements of the tool.
3.6.5. Compliance with laws and rules. Your Submission must be compliant with these Official Rules and Elastic's Community Code of Conduct; it must not contain any content, material, or element that is unlawful, illegal, derogatory, offensive, defamatory, libelous, slanderous, or otherwise objectionable or inappropriate; and it must not be in violation of any applicable laws and regulations in any jurisdiction.
3.6.6. Third-party materials. Your Submission must not contain any content, material, or element that displays any third-party advertising, slogan, logo, trademark, or branding, and it must not indicate or suggest a sponsorship or endorsement by a third party.
3.6.7. Intellectual property ownership. Your Submission must be your original, unpublished work, created solely and exclusively by you, that does not contain, incorporate, or otherwise use any content, material, or element that is owned by a third party or entity, or that violates any third-party proprietary rights, including but not limited to intellectual property rights, personality, or personal or Moral Rights.
3.6.8. Free from malware. Your Submission must be free from malware or other content adverse to the Hackathon.
3.6.9. Use of artificial intelligence. Except for generative AI tools provided by Elastic, you must not use or rely on, directly or indirectly, any artificial intelligence tools, any generative fill tools, or any other generative AI tool, program, or system in the development, creation, or building of your Submission.
3.7. Submission evaluation. During the Judging Period, the Sponsor, its agents, and/or the Judges (described below) will be evaluating each Submission to ensure that it meets the Requirements and Evaluation Criteria (as defined herein). The Sponsor reserves the right, in its sole discretion, to disqualify any entrant who submits a Submission that does not meet the Requirements.
4. Submission Period and Hackathon Period
4.1. Interested participants must submit their Idea Submission between February 2, 2026, at 5:00 p.m. AET and February 13, 2026 at 5:00 p.m. AET. Idea Submissions will be evaluated by Sponsor upon receipt and successful participants will be notified on or around February 20, 2026, at 5:00 p.m. AET. Successful participants must confirm their participation by February 26, 2026, at 5:00 p.m. AET or they will be disqualified and Sponsor may select another eligible participant.
4.2. The "Hackathon Period" begins on March 2, 2026, at 9:00 a.m. AET and ends on March 2, 2026 at 5:00 p.m. AET. During the Hackathon Period, participants will create their "Submission" based on their Idea Submission and in accordance with the requirements set out in Sections 6.3 and 6.4.
4.3. Entrants are responsible for determining the corresponding time zone in their respective jurisdictions.
4.4. The sole determinant of time for the purposes of this Hackathon will be the Hackathon server machines. Only submissions that are received during a current Hackathon Period are capable of being Submissions.
5. Eligibility.
5.1. The Hackathon is open only to legal residents of JURISDICTION (the "Territory") who are at least eighteen (18) years old or the age of majority, whichever is older, in their jurisdiction of residence. No one outside the Territory is eligible to participate in this Hackathon. Officers, directors, and employees of Sponsor and/or its affiliates, and each of their immediate family members and those residing with them or any other entity participating in the design, administration, or fulfillment of the Hackathon, are not eligible to participate or win. The Hackathon is not open to anyone prohibited from participating by law, rule, or regulation. The Hackathon is not open to any person to whom Sponsor would otherwise be prohibited from awarding a prize under any applicable law, rule, or regulation or any internal policies of Sponsor or your employer. If Sponsor, in its sole discretion, considers that a Prize may not be awarded to a potential Prize winner due to any applicable law, rule, or regulation or any internal policies of the potential Prize winner's employer, then it may instead, but shall not be obliged to, offer a substitute Prize, of the same or differing value. If you are entering as part of a company or on behalf of your employer, these rules are binding on you, individually, and/or jointly with your employer. You represent and warrant that your employer has full knowledge of, and has consented to, your actions, including your potential receipt of a prize.
5.2. Pursuant to the Anti-Bribery and Corruption Policy and Gifts & Hospitality Policy: Any participant who is also a Government or Public Official must ensure their participation and acceptance of any Prize (which constitutes a 'Thing of Value') fully complies with the local anti-bribery laws of their country and the policies of their external employing agency. Additionally, to receive the Prize, the participant must provide written confirmation to Elastic, via email, stating that their organization has reviewed and approved their acceptance of the Prize. Any Elastic employee who qualifies as a Government or Public Official must also disclose this status to the Business Integrity team by completing the Conflict of Interest Disclosure Form via Help at Elastic.
5.3. By entering this Hackathon, you represent and warrant that:
5.3.1. You are not located in a destination prohibited by the Export Administration Regulations ("EAR") (15 C.F.R. Parts 730-774 (2010)) and are not a person or entity listed on the economic sanctions regulations and guidelines of the US Department of the Treasury, Office of Foreign Asset Control ("Restricted Parties")
5.3.2. You will not export, re-export, or otherwise transfer any of Elastic's products, technology, content, information, services, or any intellectual property rights therein or related to any of the foregoing ("Elastic Technology"), or permit any Elastic Technology to be used by, or disclose any Elastic Technology to, any prohibited destination or Restricted Party
5.3.3. Your Submission is compliant with the requirements set out in Section 3.3
5.3.4. You shall indemnify and hold Sponsor harmless from and against claims, losses, costs, or liability arising out of or in connection with your breach of this section
6. Prizes.
6.1. Sponsor may award up to a total of three (3) "Prizes", as follows:
6.1.1. A Grand Prize, which consists of one (1) Meta QuestⓇ 3S per participant in the successful group (ARV of 400 AUD each)
6.1.2. A First Runner Up Prize, which consists of one (1) LEGOⓇ Star Wars Millenium Falcon set per participant in the successful group (ARV of 300 AUD each)
6.1.3. A Second Runner Up Prize, which consists of a gift voucher from David Jones in the amount of 250 AUD per team member in the successful group (ARV of 250 AUD each)
6.2. Odds of winning depend on the number of eligible entries received during the Hackathon Period and the skill of the entrants. There is a total limit of one Prize per participant.
7. Judging process, criteria, and selection.
7.1. All Submissions will be judged by a panel of experts who are Elastic employees (collectively, the "Judges") on or about the period between March 2, 2026, at 9:00 a.m. AET and March 2, 2026, at 5:00 p.m. AET.
7.2. Submissions will be evaluated on the following equally weighted criteria (collectively, the "Evaluation Criteria") and will be given a "Final Score."
Innovation (25%) Novelty of the idea and its use of generative AI. (We strongly encourage the use of Elastic Agent Builder.)
Impact (20%) Practical applications and the potential to solve real-world problems
Presentation (10%) Clarity of the demo and pitch
Technical Implementation (30%) Effective use of Elasticsearch and "mentioned technology relevance"
User Experience (15%) Simplicity, design, and usability
7.3. Any Submission that: (i) includes code plagiarism, (ii) makes material use of a competitor product or service; (iii) infringes or misappropriates any third-party rights, or (iv) is late, may be disqualified.
7.4. The Grand Prize will be awarded to the Submission received during the Hackathon Period with the highest Final Score. The First Runner Up Prize will be awarded to the Submission received during the Hackathon Period with the second highest Final Score. The Second Runner Up Prize will be awarded to the Submission received during the Hackathon Period with the third highest Final Score.
7.5. In the event of a tie between participants, Sponsor will award the Prize to the participant who had the highest points under Technological Implementation.
7.6. In the event a potential winner is disqualified for any reason, the Submission that received the next highest total score may be chosen as the potential winner. All decisions of the judging panel are made by the panel acting in its sole and absolute discretion and are final and binding.
7.7. No substitution or cash redemption of any Prize by you is permitted. Elastic reserves the right to substitute a Prize with another of comparable or greater value, change the type of Prize offered, or add additional Prizes for any reason. Each winner of a Prize must follow all of the applicable Prize redemption instructions. Prizes are subject to the issuer's restriction, terms, and conditions. All federal, state, provincial, territorial, and local taxes, as well as any other costs and expenses associated with Prize acceptance and use, are your sole responsibility. Elastic will not be held responsible in the event of loss, theft, or unauthorized use of your Prize. Prizes may not be exactly as described, illustrated, or displayed. Value is subject to market conditions and currency exchange, which can fluctuate and any difference between actual market value and ARV will not be awarded. The winner shall bear all responsibility for use of the prize(s) in compliance with any conditions imposed by such manufacturer(s), and any additional costs associated with its use, service, or maintenance. All Prizes are subject to the issuer's restrictions and applicable terms and conditions. Sponsor will not be held responsible in the event of loss, theft, or unauthorized use of your Prize. If any of these situations should occur, your balance will not be refunded and your Prize will not be replaced.
7.8. Prize award is subject to eligibility verification. Prior to receiving any Prizes, potential winners may be required to complete, sign, have notarized (if applicable), and return, by the date specified by Sponsor: (i) an affidavit of eligibility and liability/publicity release, which may require successfully completing any jurisdiction specific requirements; (ii) applicable tax documentation for their jurisdiction; (iii) applicable employment agreement or policy to verify such policies permit the acceptance of a Prize; and/or (iv) any agreement or terms of use applicable to the Prizes. In the event the Prize cannot be claimed or awarded in accordance with these Official Rules, then at Elastic's option, the Prize may be forfeited and/or awarded to an alternate winner of Elastic's choosing, or Elastic may elect not to award that Prize. No Submission or individual shall be deemed a winning Submission or winner until their prize documents have been completed and verified.
8. Hackathon winner selection and notification.
8.1. On or about March 5, 2026, Sponsor will contact the potential winner by email and/or telephone, at its discretion, with information on how to collect the Prize. If (i) a potential winner does not respond within the timeframe provided in that email or cannot be reached after a reasonable attempt has been made, (ii) any prize notification or Hackathon-related communications are rejected, faulty, or returned as undeliverable, (iii) the potential winner cannot attend or participate in any portion of the Prize, and/or (iv) the potential winner does not sign the documents described in Section 7.8 above, then in each case that potential winner may be disqualified and Sponsor may select an alternate winner in Sponsor's sole discretion. Sponsor shall have no responsibility or liability toward a potential winner. Sponsor is not obligated to pursue any alternate winners; in which case, some Prizes may go unawarded. In the event that no entries are received, no Prize will be awarded.
8.2. By claiming a Prize, Prize claimant consents to the use of their name, likeness, voice, image, video, photograph, place of residence, and/or GitHub profile, without further compensation, in any publicity or marketing activities carried out by Sponsor, in perpetuity and in any media worldwide. You hereby waive any right to inspect or approve any such use and releases Elastic from any and all liability related to such uses.
9. General rules.
9.1. By registering for this Hackathon, you agree to abide by these Official Rules, Elastic's Community Code of Conduct and any decision Sponsor makes regarding the Hackathon, which Sponsor shall make in its sole discretion, and you affirm that you have all necessary right, authority, capacity, and competence to be bound by the terms of these Official Rules. All decisions made by Sponsor, including decisions made by the Judges, are made in its sole and absolute discretion and are binding and final in all respects. At any time, Elastic reserves the right to restrict participation, disqualify, and/or prosecute to the fullest extent permitted by law any entrant, potential winner, or winner who, in Sponsor's reasonable suspicion (as determined by Sponsor in its sole and absolute discretion): (i) tampers with or impairs Sponsor's website, the registration process, or the administration, security, fairness, or proper play of this Hackathon, (ii) damages or attempts to damage or cause an interruption of any online service, website, or the Hackathon, (iii) enters or participates in the Hackathon in a suspicious manner, (iv) intentionally registers more than a single participant account or attempts to participate using multiple names, identities, or email addresses, (v) provides false, untruthful, incomplete, inaccurate, or misleading information, (v) attempts to tamper with or enter, participate in, or win the Hackathon by illegal, deceptive, abusive, unfair, or fraudulent means or in any manner that is disruptive or inconsistent with the letter and spirit of these Official Rules, (vi) violates these Official Rules and/or Elastic's Community Code of Conduct, or (vii) acts in an unsportsmanlike, disruptive, obnoxious, inappropriate, threatening, illegal, abusive, threatening, or harassing manner. If disqualified, such person forfeits any and all rights to a Prize and any Prize previously awarded to them must be returned immediately upon request from Elastic, without limiting Elastic's other rights and remedies both in law and at equity. The disqualified entrant will have no claim against Elastic in respect of the Contest or the Prize which they might otherwise have won. If an entrant, potential winner, or winner is disqualified, Sponsor reserves the right, acting in its sole and absolute discretion, to terminate such person's eligibility to participate in this Hackathon and any future contests, programs, events, Hackathon, or any other promotions conducted by Sponsor.
9.2. Sponsor's failure or decision to not enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual inconsistency between disclosures or other statements contained in any Hackathon-related materials and/or these Official Rules, it will be resolved in Sponsor's sole discretion. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. All headings are for convenience only.
9.3. Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Hackathon or modify these Official Rules without prior notice or obligation, for any reason whatsoever, including but not limited to if Hackathon is incapable of running as planned, and award the prizes in its sole discretion as deemed fair and appropriate by Sponsor.
9.4. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Program-related materials, the terms and conditions of these Official Rules shall prevail, govern, and control.
10. Intellectual property and publicity release.
10.1 Except as expressly set forth in this section, participating in this Hackathon does not grant you any rights in or to Elastic's intellectual property rights. Participants acknowledge and agree that Elastic (or its licensors) retains sole and exclusive ownership of all right, title, and interest in and to the Elastic products, services, software, source code, APIs, documentation, trademarks, and any other proprietary materials provided for or used during the Hackathon (collectively, "Elastic IP"). Participants are granted a limited, non-exclusive, revocable license to use the Elastic IP solely for the purpose of participating in the Hackathon and developing their Submission. This license does not convey any ownership rights in the Elastic IP to the Participant. Elastic retains all right, title, and interest in and to Elastic technology. To the extent that a Submission incorporates, is based upon, or constitutes a derivative work of any Elastic IP, the Participant's ownership is limited strictly to the original portions of the Submission created by the Participant. The Participant shall not acquire any ownership interest in the underlying Elastic IP through its incorporation into a Submission.
10.2 Subject to and in accordance with the terms and conditions of these Official Rules, in the event you create and submit a Submission, you warrant and represent that you are the sole and exclusive owner and rights holder of all of the intellectual and industrial property rights in and to the Submission, and you have the full power, right, and authority to submit the Submission in the Hackathon and to grant the licenses and rights set out in these Official Rules, without violating any third-party rights, contractual obligations, or non-disclosure agreements.
10.3 To the extent participants have ownership or intellectual property rights in their Submission, or any element thereof, and subject to Section 10.1, participants will retain such ownership and intellectual property rights. By participating in the Hackathon, each Participant (and the entire team, as applicable) hereby grants to Elastic a perpetual, irrevocable, non-exclusive, fully paid, royalty-free, transferable, assignable, sublicensable, and worldwide license (the "License") to use, reproduce, modify, create derivative works of, display, adapt, perform, distribute, and otherwise exploit, in any medium now known or later developed, any and all intellectual property, data, materials, deliverables, concepts, ideas, code, designs, documentation, and other creative works or outputs created, developed, or submitted to or in connection with the Hackathon, for purposes including, but not limited to: (i) showcasing winning projects on the Hackathon website, social media, and promotional materials; (ii) internal evaluation and review; (iii) demonstrating the outcomes of the Hackathon to stakeholders.
10.4 To the fullest extent permitted by applicable law, you agree to waive and not to assert any and all "Moral Rights" (including, without limitation, rights of attribution and integrity) you may have against Elastic or its sublicensees. If such Moral Rights cannot be waived under any applicable law, you agree that you will not exercise such Moral Rights in any manner that interferes with Elastic's full exercise of the License granted herein.
10.5 Each participant hereby grants Sponsor the irrevocable, perpetual, sublicensable, free of charge, royalty-free, worldwide right and permission to use, publish, post, translate, modify, edit, combine, disassemble, distribute, make available by wire or wireless means, publicly perform, and/or display in any medium now known or hereafter discovered, all participant information in each case for advertising, trade, promotional, and publicity purposes, in connection with the Hackathon and its promotion, without further compensation of any kind and without any further notice. Each participant hereby waives any right to inspect or approve any such use and releases Sponsor from any and all liability related to such uses. Each participant agrees and understands that information on websites, such as participant Information, can be viewed throughout the world and that some overseas countries may provide lower levels of protection to the rights of individuals compared to other countries.
11. Disclaimer, release, and limit of liability.
11.1. TO THE EXTENT PERMITTED BY LAW, ELASTIC MAKES NO REPRESENTATIONS, CONDITIONS, GUARANTEES, OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE HACKATHON AND EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS. BY PARTICIPATING IN THE HACKATHON, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS ELASTIC AND ITS SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY'S OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY, THE "RELEASED PARTIES") FROM AND AGAINST ANY LOSS, DAMAGE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THIS HACKATHON OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.
11.2. THE RELEASED PARTIES ARE NOT RESPONSIBLE OR LIABLE FOR: (i) ANY LOST, LATE, INCORRECT, INCOMPLETE, INCOMPATIBLE, OR MISDIRECTED CONTRIBUTIONS, INFORMATION, CORRESPONDENCE, OR MATERIALS, WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS, OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE HACKATHON; (ii) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, DELAYS, OR DISCONNECTIONS IN PHONE OR CABLE LINES, NETWORK CONNECTIONS, ELECTRONIC EQUIPMENT, COMPUTER HARDWARE OR SOFTWARE, OR ELECTRONIC COMMUNICATIONS; (iii) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE REGISTRATION PROCESS OR THE HACKATHON; (iv) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE HACKATHON OR THE PROCESSING OF CONTRIBUTIONS; (v) ANY VIRUSES OR TECHNICAL OR MECHANICAL MALFUNCTIONS; (vi) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT'S PARTICIPATION IN THE HACKATHON OR RECEIPT OR USE OR MISUSE OF ANY PRIZE; AND (vii) ANY CHANGES OR UNAVAILABILITY OF THE HACKATHON WEBSITE THAT MAY INTERFERE WITH THE HACKATHON OR ABILITY OF THE ENTRANT TO TIMELY PARTICIPATE, RECEIVE NOTICES, OR COMMUNICATE WITH ELASTIC, IN WHICH CASE ELASTIC, IN ITS SOLE DISCRETION, MAY TERMINATE OR MODIFY THE HACKATHON.
11.3. If for any reason your registration and/or submission(s) are confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, your sole remedy is another Submission in the Hackathon. Unless otherwise specified, no more than the stated number and types of prizes will be awarded and in no event will Sponsor be liable for more than the stated number of Prizes in these Official Rules. In event that production, technical, programming, or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by selecting the winner in its sole discretion among all legitimate, unawarded, eligible prize claims.
11.4. Without limiting any other provision in these Official Rules, Sponsor is not responsible, or liable for failure to operate the Hackathon or supply the prizes or any part thereof in the event that any of the Hackathon activities or Sponsor's operations or activities are affected by a force majeure event, as determined by the Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order, or request by any governmental or quasi- governmental entity, equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, pandemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order, or other action adopted or taken by any governmental, federal, state, provincial, or local government authority, or any other cause, whether or not specifically mentioned above.
12. Privacy and use of personal information. Elastic collects personal information from individuals when they enter this Hackathon. Elastic reserves the right to use any information collected in accordance with the Elastic General Privacy Statement.
13. GOVERNING LAW AND DISPUTES. These Official Rules, the Hackathon, and all related issues are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia sitting in Sydney, and any courts that may hear appeals from those courts, for any dispute arising out of or relating to these Official Rules. EXCEPT WHERE PROHIBITED, AS A CONDITION OF PARTICIPATING IN THIS HACKATHON, YOU AGREE THAT THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER DAMAGES OR LOSSES OF ANY KIND.
