Elastic Cloud Serverless Public Gated Preview Terms of Use (“Terms”)

These Terms apply to the public gated preview of the Elastic Cloud Serverless feature ("Preview") and shall be effective as of the date on which it is fully executed ("Effective Date") by the entity participating in this Preview ("you" or "your") and Elasticsearch Inc. ("Elastic", "we" or "us").

  1. 1. For this Preview, you will obtain access to the Elastic Cloud Serverless feature ("Serverless Offering") for evaluative purposes only. Support services will be provided at Elastic's reasonable discretion, and no service level terms or outage penalties will be provided. This Preview will be available free of charge and shall be subject to your reasonable use of the Serverless Offering in Elastic's discretion.
  2. 2. We would like you to share your ideas and suggestions on the Serverless Offering with Elastic. We may use this feedback to enhance our Serverless Offering.
  3. 3. Our existing mutual confidentiality obligations already in place between us will apply to the Serverless Offering.
  4. 4. We may use data uploaded to the Serverless Offering ("Data") and transform it solely subject to confidentiality and for the purpose of enabling a fully functional Serverless Offering. You are responsible for backing up Data, and we will not be responsible for any loss or damage to Data. We will not assess the contents or accuracy of Data, including to identify Data subject to any specific legal, regulatory, or other requirement.
  5. 5. This Preview will begin when you are given access to the Serverless Offering and end upon Elastic's notice to you.
  6. 6. The Serverless Offering is still in the testing phase and may not be fully functional. We are providing this on an 'as is' and 'as available' basis. Elastic's maximum liability to you in all circumstances under this Preview is capped at US$100.
  7. 7. Access to the Serverless Offering may be available to you after the expiration of this Preview with the pricing, support terms, and documentation included in your agreement and as communicated to you by Elastic. You may use any pre-purchased entitlements towards your consumption of the Serverless Offering and your existing Data Privacy Agreement ("DPA") or the DPA at www.elastic.co/pdf/v100623-0-elastic-customer-dpa.pdf shall apply as necessary to align with the Serverless Offering.
